1. General
These Terms of Service (“Terms”) govern your use of sinkly.eu and purchases made in our store. The seller is identified in section 13 at the end of these Terms (“we”, “us”).
We deliver to all member states of the European Union. Contracts are concluded in English.
Nothing in these Terms limits or excludes any mandatory rights you have as a consumer under applicable law.
2. Products
We make every effort to present our products accurately. Colours may appear slightly different depending on your screen and device settings.
3. Placing an order
To place an order, add the product to your cart, go to checkout, enter your contact and delivery details, and choose a delivery and payment method. Before submitting, you can review your order and correct any errors. By clicking the button confirming your order with an obligation to pay, you submit an offer to purchase.
The contract is concluded when we send you an order confirmation by email. Before sending the confirmation, we may decline an order, for example if the product is unavailable or payment has not been received; in that case we will refund any payment immediately.
4. Prices and payment
All prices are in euro and are final prices, including any applicable taxes. Delivery costs are shown before you place your order. The price that applies is the one shown at the time you place your order.
We accept the following payment methods: Credit and debit cards, PayPal, Apple Pay, Google Pay, Klarna. Payment is due when you place your order.
5. Delivery
We ship orders within 1-2 business days of receiving payment. Delivery usually takes 5 business days, depending on the destination country. Risk of loss or damage to the goods passes to you when the goods are delivered to you.
6. Right of withdrawal
As a consumer, you have the right to withdraw from the contract within 14 days without giving any reason. Details, including the model withdrawal form, are set out in our Return and Refund Policy - https://sinkly.eu/policies/refund-policy.
7. Out-of-court dispute resolution
If we reject your complaint, we will inform you whether we agree to resolve the dispute out of court. You can also contact the consumer protection authority in your country or the European Consumer Centre (ECC-Net) for help.
8. Use of the website
You may use our website only for lawful purposes. You must not interfere with its operation or security, upload malicious code, or use automated tools in a way that disrupts the website. All content on the website, including text, images and design, belongs to us or our licensors and may not be copied for commercial purposes without our permission.
9. Liability
Nothing in these Terms excludes or limits our liability where it cannot be excluded or limited under applicable law, including our liability towards consumers for any lack of conformity of the goods.
10. Relationship with Shopify
SINKLY is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with SINKLY. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and SINKLY, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with SINKLY.
11. Privacy
We process your personal data in accordance with our Privacy Policy - https://sinkly.eu/policies/privacy-policy.
12. Governing law and changes
These Terms are governed by Polish law. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you have your habitual residence. As a consumer, you may bring proceedings before the courts of your country of residence or of Poland.
We may update these Terms from time to time. Each order is governed by the version of the Terms in force at the time the order was placed.
